Welcome to use Neonarcade (hereafter referred to as "Neonarcade," "we," "us" or "our") and become a part of our creative community!
As the operator of Neonarcade, Skywork AI Pte Ltd., ("we" or "us"), we respect your right to privacy and highly value the protection of your Personal Data. This Neonarcade Privacy Policy ("Privacy Policy") explains how we collect, process and protect your Personal Data when you use Neonarcade and how you can exercise your rights to Personal Data protection. For information that demands your particular notice and that may have a significant impact on your rights and interests, we have highlighted it in bold font to draw your attention. 1. What types of Personal Data do we collect and our purposes
The scope of Personal Data we collect depends on the functions of Neonarcade you use and how you use these functions. The purposes and types of Personal Data we collect are summarized in the below.
When you use our Services, you consent to our combining various types of Data we collect about you—including Data you voluntarily provide, Data automatically gathered through your interaction with the Services (as described above), and Data we may lawfully obtain from third parties—for purposes such as personalizing our communications with you and enhancing the functionality and performance of our Services. If you do not agree to this data combination practice, please refrain from using the Platform or any of the Services.
In certain situations, you may be required to provide specific categories of Data to us—for example: (i) where mandated by applicable laws or regulatory obligations; (ii) where necessary to perform a contract between you and us; (iii) where needed for us to enter into a contract or agreement with you; or (iv) where you are otherwise legally or contractually obligated to share such Data with us. In any such case, we will clearly notify you in advance and explain the potential consequences of not providing the requested Data.
A. The Personal Data you directly provide to us / fetched by us with authorization from you
Registration and Log-in. If you choose to register for a Neonarcade account by Email, we may need to collect your basic profile information such as your user nickname, etc. After you have logged in, you may also choose to add additional Personal Data to your personal profile page and may show your personalized image (including real-face photos/artworks). New users of Neonarcade may also register and log in through a third-party platform account (e.g., Apple ID, Google).
To further clarify, we may collect the age/birthday provided by users for (i) compliance with laws. By requiring users to provide age/birthday information, Neonarcade can restrict access to certain features and content that may not be appropriate for minors to comply with laws in different regions, and request consent from their parents to their children's use of Neonarcade, and the process of the minor's Personal Data and/or any purchase that occurs on the Platform; (ii) account security and authentication. By verifying a user's age/birthday, Neonarcade can better protect users from fraudulent accounts, unauthorized access, and other security issues; (iii) community safety and compliance. Age/birthday information helps identify and address issues related to minors, such as the protection of minors and the prevention of child abuse or delinquent behavior; (iv) ad targeting and personalized experience. Neonarcade uses age/birthday information to better understand the characteristics of its users, to provide a more personalized experience, and to ensure that ads are more accurately delivered to the target user, except where not permitted under laws in certain regions.
If you refuse to provide the above Personal Data, you will not be able to complete the registration and log-in and will not be able to view content or to use certain features on Neonarcade.
User Content. When you use our services, we collect Personal Data that includes texts, photos, images, audios, videos, comments, questions, messages, works of authorship, and other content or information that you generate, transmit, submit to us, or otherwise make available on Neonarcade ("User Content") to facilitate your creating and publication of User Content, we also collect the associated metadata such as the time you use, location data where you register and/or use, etc., depending on the specific function you use. After you generate, create and post your User Content, we will generate and process data related to your User Content. Please be assured that we will anonymize or delete relevant extracted data as soon as we have completed our recommendation and we will not use such data for other purpose.
AI Game Creation. When you use our AI game creation features, you may input text descriptions and upload reference images to generate games. We collect this input text and images to process your creative requests and generate the corresponding game content. We also collect information from your mobile photo album to facilitate image selection and processing.
AI Interaction Data. When you use AI generation features, your prompts, inputs, and generated outputs may be processed by third-party AI service providers to generate results and ensure service functionality. We may also retain these inputs and outputs for service delivery, troubleshooting, and feature improvement. Third-party AI service providers may retain your prompts and generated outputs to improve, train, and optimize their AI models, in accordance with their privacy policy.
User Content and Interaction. When you use our services, we collect Personal Data that includes texts, photos, images, comments, questions, messages, and other content or information that you generate, transmit, submit to us, or otherwise make available on Neonarcade ("User Content"). This includes data from your interactions, such as likes, collections, and shares.
Contact and Marketing. We may use the contact information provided by you (e.g., email address and mobile phone number) to conduct user survey or to send you information about products and services that may be of interest to you. Where required by applicable laws and regulations, we will obtain your consent before sending you marketing messages. If you are not interested in such information, you may refuse at any time during the communication, for example, by clicking on the unsubscribe/refuse option or contact us to opt-out.
B. The Personal Data provided by you or generated during your use of Neonarcade
Content Viewing. You are unable to view User Content within Neonarcade unless you register for a Neonarcade account and complete log-in. After you log in, we may collect your browsing history so that you can record and further view the content you have viewed.
Game Preferences. New users are guided to select their preferred game categories (e.g., Logic, Reaction, Casual, Emotional Narrative). We collect this preference data to provide personalized game recommendations.
Device and Usage Data. To improve your user experience and ensure the stability of the service, we automatically collect information about your device and usage patterns. This includes: device identifiers (such as Android ID, IDFA, etc.), operating system information, network information (e.g., IP address), clickstream data, and interaction information. Additionally, with your permission, we may access your camera and microphone to enhance AI generation results based on your inputs.
Advertising Identifiers and App Event Data. Where permitted by applicable law or with your consent where required, we may collect and process mobile advertising identifiers and related app event data for advertising attribution, measurement and campaign optimization. This may include Android Advertising ID / Google Advertising ID (GAID/AAID), IDFA where applicable, IP address, device and usage information, app installation source, app launch information, advertising click or impression information, and events generated when you interact with Neonarcade, such as registration, log-in, purchase, subscription, game progress, game completion, content interaction, ad view, ad click or other conversion events. We use this information to measure whether our advertising campaigns result in installs or in-app activity, optimize and limit advertising, prevent fraud and abuse, and, where permitted, provide or measure personalized advertising. You may reset, limit or delete your mobile advertising identifier through your device settings, and you may withdraw consent where applicable as described in this Privacy Policy. We do not knowingly use advertising identifiers or app event data for targeted advertising to children or in any manner prohibited by applicable laws.
Inferred and Associated Data. We may process data locally on your device to enable special AI features. For example, when processing input materials for portrait generation, facial feature points may be processed locally to enable special effects. This data is deleted immediately after processing unless you choose to save the generated content.
Payment and Transaction. When you use our top up or payment functions and initiate a payment request, we need to collect your user ID, country/region, payment currency, payment amount, payment time, payment method, order number and other information to complete the payment and transaction process via the Application Program Interface (API) supported by the third-party payment service providers. In order to prevent money laundering and related illegal activities, we prohibit any withdrawal of credit or virtual goods from Neonarcade.
Feedback and Report. When you use the feedback function within Neonarcade, we need to collect the feedback description and screenshots provided by you. If you do not provide such information, we may not be able to help you resolve the issue or respond to your feedback. In addition, if you wish to make a report (for example, when you discover any illegal content, illegal user activity, or your rights have been violated), we need to collect a description of your report, the type of report, and proofs (including but not limited to screenshots, certificate of ownership/authorization letter) in order to understand the facts and help you resolve the issue.
Improving User Experience. To improve your user experience (e.g., by making it easier for you to view information about your account, sending you push notifications, and providing you with personalized content and services that may be of interest to you), we or our designated partners may automatically collect information about your language, gender, clicks and actions, program progress (including log-in status, interaction information/status, achievement information, etc.), application token, operating system, network information (e.g., IP address), device data (e.g., IMEI and other device identifiers), country/region, device model, screen resolution, geographic location, anonymous user identifier, etc., and analyze such data.
Maintaining Functionality, Stability and Security. In order to maintain the functionality, stability and security of Neonarcade and your account, we will automatically collect data related to the operation of your online operations, such as data related to your log-in status, clicks and actions, user device data (unique identifiers (e.g. IMEI), manufacturer and model, browser type, screen resolution, RAM and disk size, CPU usage, device type, language settings, mobile device carrier, radio/network information (e.g., Wi-Fi, LTE, 3G), operating system data), network information (e.g., IP address), and general location information such as city, state or geographic area, etc. when you are using Neonarcade.
Inferred and Associated Data. When you use our Services, we may collect metadata accompanying user-generated content, audiovisual clips segmentation, annotation, frame or text extraction, object and image recognition symbolling, aggregated classification tagging and other non-personally identifying information inferred from the Personal Data you provide to us or that we collect during your use of Neonarcade. We may process this data locally on your device to enable special video effects, and it will be used solely to provide the mentioned features. The above data cannot be used to identify any individual. We will not use the aforementioned data for any purposes other than those explicitly stated in this Policy.
C. Mandatory Data Provision
You may be required to provide certain categories of Personal Data to us under the following circumstances: (i) as required under any applicable laws or regulations; (ii) as required under any contract entered into between us; (iii) as required for us to enter into any contract or agreement with you; or (iv) that you are otherwise obliged to provide the Personal Data to us. If that is the case, we will inform you thereof separately, and will also explain the possible consequences if you fail to provide such Personal Data.
D. The Personal Data provided by third parties
Third-Party Register and Log-in. To make it easier to use Neonarcade, you may also choose to register and log-in within Neonarcade through your account on a third-party platform (e.g., Apple, Google). In such cases, we may collect your nickname, avatar, third-party account email and Open ID, birthday/age, gender, friend list, location, and by logging in through these third-party accounts, you are consenting to the third-party providing us with the Personal Data concerned. We may also use the contact information (e.g., email address, cell phone number) provided by the third-party platforms to send verification messages, conduct user survey or to send marketing messages to you. Where required by applicable laws and regulations, we will obtain your consent before sending you marketing messages. If you are not interested in such information, you may refuse or opt out at any time.
Additionally, to ensure the stability, security, and optimization of our services, we integrate specific third-party Software Development Kits (SDKs) into Neonarcade, such as the Firebase SDK (for push notifications and analytics) and the Alibaba Cloud Log Service SDK (for custom event tracking and data analysis). These SDKs may automatically collect certain technical data, including your device information, network status, and usage behavior. This data collection allows us to effectively analyze application performance, troubleshoot technical issues, and deliver personalized content to enhance your overall experience.
For advertising attribution and measurement, we may also integrate advertising and measurement SDKs, including Meta SDK / Facebook SDK and Meta App Events. These SDKs may collect or receive advertising identifiers, device information, network information, usage behavior and app event data as described above. They help us measure advertising performance on Meta platforms, understand campaign effectiveness, optimize ad delivery, and support fraud prevention and security. Where required by applicable law, we will obtain your consent before enabling the collection or sharing of advertising identifiers or app event data for these purposes.
If you provide us with any Personal Data of any data subjects other than yourself, please bring this Privacy Policy to their attention. You hereby acknowledge that you have obtained their consent or completed other formality as required by other lawful bases for the Personal Data processing in lieu of consent before providing such Personal Data to us. By submitting such information to us, you represent to us that you are entitled to provide and we are entitled to process the relevant Personal Data for the purposes as stated in the Privacy Policy.
In general, we will use your Personal Data only for the purposes described in this Privacy Policy or for purposes that we explain to you at the time we collect the relevant Personal Data. However, we may also process Personal Data for other purposes that are not incompatible with the purposes that we have disclosed to you if and where it is permitted by applicable laws and regulations. 2. How do we use cookies and similar technologies
Like many online services, we may use cookies and similar technologies to operate and provide our Services and to improve user experience. Cookies allow Neonarcade to access or store information from your settings or your device. They are mainly used to ensure Neonarcade's expected functionality.

If you do not accept these cookies, you may not be able to use all functions of Neonarcade. For example, we use first-party cookies to save your Log-in information for future Log-ins to our service. In order to protect the privacy and Personal Data of minors, you are required to have your parent's consent to use the Service, and we may verify parental or legal guardian's consent where the local laws in your country or region require before processing minors' Personal Data. If you are a parent or legal guardian of a minor, please ensure that you have read this Privacy Policy and are responsible for your child's activities before allowing your child to create his or her own Neonarcade account and use the application. You are suggested to pay close attention to your child's use of Neonarcade and to ensure that your child only uses age-appropriate functions.

We strongly recommend that parents and guardians educate their children to never disclose or provide any Personal Data about them without your prior permission when using our services. If you are a parent or legal guardian and discover that an individual under your care has used our Services or provided Personal Data without consent, please terminate their use of our Services immediately and notify us promptly at the contact details listed in the "How to Contact Us" section so we can take appropriate action. If we learn that we have collected Personal Data from minors under the corresponding age limit in your country or region without the permission of their parents or legal guardians, we will delete such Personal Data as soon as possible.

5. How do we protect your Personal Data
To provide you with a privacy-friendly environment, Neonarcade offers a variety of privacy protection features to limit the Personal Data that other users can see. In addition, you can also set the types of notifications (e.g., content updates, online alerts, interactive messages, popular recommendations, etc.) you want to receive or reject within Neonarcade.
We use appropriate technical and organizational measures to protect your Personal Data that we collect and process. The measures that we use are designed to provide a level of security appropriate to the risk of processing your Personal Data. For example, we adopt encryption at rest to secure all user data (including database files and backups) and use security keys for data management. We adopt encryption in transit through TLS 1.2 protocols to protect data flow in the public network environment from user devices to servers and from servers to servers. A. Cross-border Transfer
We and our designated server partners deploy local servers in several countries around the world. For the need of our global operation and security management, your Personal Data may be transferred to and processed in other jurisdictions where our affiliated entities are based in, which may be different from the jurisdiction you locate. Such jurisdictions may not provide the same level of data protection as your jurisdiction. Under such circumstances, we will take necessary and appropriate safeguards to ensure the security of your Personal Data in transit and require that the recipient of your Personal Data offers an adequate level of protection and security in accordance with this Privacy Policy and applicable laws and regulations.

For Personal Data such as nickname, birthday, country/region, registration and log-in information and other information that you voluntarily provide to us, you can view them in your personal profile within Neonarcade; for Personal Data that you provide and generate while using Neonarcade (e.g., User Content, etc.) as well as Personal Data that third parties provide to us (e.g., third-party platform account information, payment information, etc.), you can access them within the corresponding functions of Neonarcade or by contacting us. You also have the right to request a copy of your Personal Data from us, by contacting us using the contact details provided in the "How to contact us" section below.
B. Correct your Personal Data
We will endeavor to ensure that your Personal Data is accurate and up-to-date by implementing appropriate measures. If your Personal Data is inaccurate or incomplete, you have the right to correct such Personal Data. For Personal Data such as nickname, birthday, country/region, registration and log-in information and other information that you voluntarily provide to us, you can correct them within your personal profile within Neonarcade; for Personal Data that you provide and generate while using Neonarcade (e.g., User Content, etc.), if you think such Personal Data needs to be corrected, you can contact us using the contact details provided in the "How to contact us" section below. Please note that for Personal Data provided by third parties, we may not be able to keep the information up-to-date and you may need to contact the third-party for correction.
C. Delete your Personal Data
You have the right to request us to delete your Personal Data, including your Neonarcade account and related Personal Data. You can do this by contacting us using the contact details provided in the "How to contact us" section below or use available function to delete your User Content or your Account. Please note that after you submit a request to delete your account, you will no longer be able to use Neonarcade, so please decide carefully. In addition, we will also voluntarily delete your Personal Data after the expiration of the retention period of the Personal Data when the purposes of processing in the first part of this Privacy Policy no longer exist.
If we terminate our services or operations, we will notify you at least thirty (30) days in advance and will delete or anonymize your Personal Data after termination of services or operations.

10. Governing law and dispute solution
This Privacy Policy is governed by the internal substantive laws of Singapore, without respect to its conflict of law provisions. Any dispute arising out of or in connection with the Privacy Policy, including any question regarding existence, validity or termination of the Privacy Policy, shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre ("SIAC") in accordance with the Arbitration Rules of the Singapore International Arbitration Centre ("SIAC Rules") for the time being in force, which rules are deemed to be incorporated by reference in this clause. The seat of the arbitration shall be in Singapore. The Tribunal shall consist of three (3) arbitrators. The language of the arbitration shall be English.

When requesting removal, you must be specific about the information you want to be removed and provide Neonarcade with specific information, such as the URL for each page where the information is located, so that we can find it. Neonarcade is not required to remove any information where: (i) federal or state law requires us or a third party to maintain the information; (ii) the information was not posted by you; (iii) the information has been anonymized by Neonarcade so that you cannot be identified from such information; (iv) you do not follow our instructions for removing or requesting removal; or (v) you received compensation or other consideration for providing the information. Removal of your information from the services does not ensure complete or comprehensive removal of that information from our systems or the systems of our service providers. In addition, materials that you have posted may be republished or reposted by another user or third party. Please note, Neonarcade is not required to destroy the information; Neonarcade's obligations under California law are satisfied so long as we anonymize the information or render it invisible to other users and the public.
Do Not Sell My Personal Data: Where applicable, the California Consumer Privacy Act ("CCPA") provides you with the right to opt out of the "sale" of your Personal Data. We generally do not directly sell your Personal Data in the conventional sense (i.e., for monetary or other valuable consideration). Like many social and entertainment mobile Platform, however, we use services that help deliver interest-based ads to you and may transfer Personal Data to business partners for their use. Making Personal Data (such as online identifiers or browsing activity) available to these companies may be considered a "sale" under the CCPA. To request that Neonarcade may not "sell" your Personal Data, please contact us using the contact details provided in the "How to contact us" section below. Please note, some transfers of your Personal Data may not be considered "sales" and certain exemptions may apply under the CCPA, such as sharing aggregated demographic and interest data of users. Your selection does not affect other sharing of your data, as outlined in this Privacy Policy. You may still see some advertising, regardless of your selection.
Do Not Track: At this time, we are not aware of worldwide uniform or consistent industry standard or definition for responding to, processing, or communicating Do Not Track signals. Accordingly, our services may be unable to respond to "Do Not Track" requests from browsers. In addition, when you use our services, we and third parties may use tracking technologies to collect your Personal Data about your online activities for a variety of purposes, including serving you advertising and personalized content. If you want to opt out of having your online activity and device data collected by third parties, there are a number of tools and methods that any user may use. For example, your mobile device settings may provide functionality to limit use of the advertising ID associated with your mobile device for interest-based advertising purposes. Please note that using these tools to opt out of tracking and targeting does not mean that you will not receive advertising while using Neonarcade, nor will it prevent the receipt of interest-based advertising from third parties. Additional Information: If you choose to exercise any of your rights under the CCPA, you have the right to not receive discriminatory treatment by us. To the extent permitted by applicable laws and regulations, we may charge a reasonable fee to comply with your request.
12. Colorado Privacy Act (CPA)
If You are a User in Colorado, this Addendum applies to you. Except as otherwise modified by this Addendum, all provisions of the above Privacy Policy shall remain in full force and effect. Under the CPA, you have the right to:
Neonarcade shall not discriminate against you for exercising any of these rights, which is further in line with your rights under the CPA. After the first request, Neonarcade may charge such amount as may be required to process such requests.

We will acknowledge receipt of your request within 3 (three) business days, and provide a substantive response within 45 (forty five) calendar days, thereafter you shall have the right to appeal within 15 (fifteen) business days.
On receipt of your appeal, Neonarcade shall provide a substantive response within 45 (forty-five) calendar days or inform you of the reason and extension period of an additional 60 (sixty) days (total up to 105 (one hundred and five) days) in writing. In the event that you are dissatisfied, you have the right to approach the Attorney General of Colorado.
